Using specific cases as examples, Mark McGrory and Chuck Fox of Demonstratives, Inc. (DI), provide a graphically rich presentation on how 3D animations and 2D graphics have been used effectively both in litigation and as a catalyst for settlement. Mr. McGrory provides an attorney’s perspective on how graphics can be an important part of the record. He discusses admissibility issues for demonstratives exhibits as well as the difference between demonstrative evidence and demonstrative aids. Mr. McGrory also discusses the federal rules relating to the use of demonstratives. In addition, he offers some key considerations for their use.
Dr. Fox provides a scientist’s perspective on how expert-level graphics and animations created specifically for litigation purposes have positively affected many significant cases. Using animation examples from specific case studies, Dr. Fox illuminates the ways high-quality demonstratives solve common communication dilemmas regarding presentation of complex and/or theoretical information.
Demonstratives, Inc. has created animations for intellectual property, construction, environmental, product liability and personal injury cases with a number of clients in the aviation, automotive, medical device, and other industries. DI’s case study based approach draws upon experience in over 1500 cases and provides best practices for how to use animations and graphics as tools to help effectively to resolve disputes.

Mark joined DI in 2008 after 12 years at Sprint Corporation as senior counsel, where he oversaw all of Sprint’s intellectual property litigation, as well as Sprint’s most significant complex commercial litigation. As in-house counsel at Sprint, Mark worked with many major law firms across the country and participated in numerous trials, arbitrations and mediations. Previously, he was a member of the litigation department at Kansas City’s Morrison & Hecker firm (now Stinson Morrison Hecker) for 12 years, including 6 years as an equity partner. Mark received his juris doctorate from the University of Iowa and is rated AV by Martindale-Hubbell.
Chuck led the DI team (Affymetrix v. Illumina) that illustrated DNA microarray technology, which helped Affymetrix’s attorneys show how Illumina infringed Affymetrix patents, resulting in a $90 million settlement for Affymetrix. He has been Vice President of DI since 2001. Chuck has 13 years of experience leading projects in biotechnology, pharmaceuticals, and medical devices. Prior to working at DI, he served as Director of Production at EAI. Chuck received his doctorate in Molecular, Cellular, and Developmental Biology from Iowa State University and was a Pharmaceutical Manufacturers Postdoctoral Fellow at the University of Michigan.
